Family legal costs in South Africa are unusually hard to quote because the same matter can cost five thousand rand or five hundred thousand depending on one thing: whether the two of you agree.
The figures on this page are typical market ranges, not fixed prices. They exclude VAT and disbursements such as sheriff's fees, Deeds Office fees, courier costs and expert reports. Firms differ, cities differ, and a quote outside these ranges is not automatically wrong.
What actually drives the cost
Agreement or conflict. This is the whole game. An uncontested divorce is a short, largely administrative matter with one brief court appearance. A contested divorce is full litigation with pleadings, discovery, expert reports and a trial. The gap between them is not a percentage, it is an order of magnitude.
How the fee is structured. Some firms quote a flat fee for a defined uncontested divorce. Others bill by the hour throughout. Flat fees are usually good value, but read what they exclude. Most assume your spouse signs everything without changes and does not file a notice of intention to defend. The moment they do, hourly billing generally starts.
Complexity of the estate. A business, a trust, a farm, a pension interest, offshore assets or a property in more than one name all take time to value and to divide, and time is what you pay for.
The other side's behaviour. A spouse who hides assets, changes attorneys or postpones repeatedly will drive up your bill even if you are being entirely reasonable. Courts can award costs, but that is discretionary and it arrives long after you have already paid.
Experts. A social worker, psychologist, forensic accountant or actuary is sometimes necessary and is a large line item. These appear in contested matters, almost never in uncontested ones.
What is free
A surprising amount of the family law system costs nothing, and people pay for it unnecessarily.
- The Maintenance Court, in the Magistrates' Court, deals with child and spousal maintenance. Applying is free, enforcing an order is free, and you do not need an attorney.
- A protection order under the Domestic Violence Act 116 of 1998 is applied for free at any Magistrates' Court, and an interim order can be granted the same day.
- The Office of the Family Advocate assists in matters involving children, helps parents agree a parenting plan, and can investigate and report to a court on the child's best interests. There is no charge.
- The Children's Court, also in the Magistrates' Court, deals with parental responsibilities and rights, care and contact. Approaching it is free.
- Legal Aid South Africa on 0800 110 110 takes on some family matters, particularly where a child's interests are involved. There is a means test, so phone and ask.
- University law clinics in most large centres take family matters for free or at very low cost.
In an emergency, the police are on 10111 and the GBV Command Centre is on 0800 428 428, day and night.
How to avoid surprises on the invoice
Ask for a written mandate and fee estimate before you instruct. It should say the hourly rate, who will do the work and at what rate, what is included, and what is not.
Ask for the quote to be split into professional fees, disbursements and VAT. A firm that will not break this down is not one you want billing you by the hour.
Ask to be billed monthly. A single invoice at the end is how people get a shock. Monthly statements let you see the cost building and change course.
Come organised. Bring your marriage certificate, antenuptial contract, identity documents, recent payslips, bank statements, and a list of assets and debts to the first meeting. Time spent hunting for documents is time you pay for.
Use email rather than telephone calls where you can. It creates a record and it is usually less billed time.
Say plainly that you do not want long letters written to score points. Correspondence is billable and rarely changes an outcome.
The cheapest thing you can do
Narrow the dispute. Mediation costs a fraction of litigation, and a mediated agreement can be made an order of court so that it is just as enforceable. Even settling three issues out of four shortens a trial and cuts the bill substantially.
Family matters get expensive when hurt is being litigated as though it were money. Decide early which of the two you are actually fighting about.
